It might look good in a cold, legal text book, but if you put the two children beside one another it would be painfully obvious that that the elderly one who was yet unborn was no less Human than the other. The application of your "unambiguous event" to real People is unambiguously and intuitively inhuman and immoral. The fact that it might be legal is irrelevant!
