If the position is, as I think it is, that they will be held so long as the WOT is ongoing, then what is unclear about that?

To imprison them for a specified time is to impose a criminal sentence. This may actually be legally sound under some older precedents I recall reading a long time ago, but my memory of the case is not fresh.

In any event, this is clearly not the position.

We do not have a clear idea of how long they will be held because we don't know how long the WOT will last. Unless something changes, it is probably a life sentence.

I think the problem you have with all this is with its fairness. After all, previous conflicts had a specified beginning and an end, after which everyone kissed, made up, and became bosom buddies once again. I can see how you find the present situation problematical.

This is different. And the legal norms are inadequate. Unfortunately, what is in place seems to be the best we can do.

I really have no problem with imprisoning the combatants for life so long as there is a reasonably good chance that releasing them can harm us. Perhaps they can be released once they reach a certain age or somehow convince us that they are no longer a danger.
