Keeping them indefinitely despite the fact that you don't have any evidence of wrongdoing is Kafkaesque, and is one of the hallmarks of a totalitarian state.

We took prisoners of war in WWII? Lots of them. Was that Kafkaesque?

Soldiers captured on battlefields wear uniforms, or can be executed for espionage.

I realize that these soldiers don't wear uniforms with insignia. Which means that they can all be executed for espionage. Maybe I was wrong. Maybe killing them is what you've been suggesting all along. You could make a case for that. Actually, you just did. Is it what you're suggesting? If not, the only alternatives are to stash them in prisoner of war camps or let them return to their units. Which do you prefer?
