Maybe if you strenuously object, that'll change the judge's opinion. Sometimes a mere objection alone just isn't enough, but if you strenuously object, there may be some prevailing hope.

Kathy, is it true one reason your lawsuit was dismissed was for failure to state a claim?

The general rule in appraising the sufficiency of a complaint for failure to state a claim is that a complaint should not be dismissed '***unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.' In my experience, that's a mistake - and I hope you raised new law in that motion because FRCP is strict on this: a motion for reconsideration is not a second bite at the apple, like my friend Rea just tried by ignoring the rules and filing a second motion to dismiss, which, by the way, was drafted by an attorney and filed as if he drafted it himself.

Maybe you should file where jd is unquestionable - if your claims have merit. If they don't, then obviously filing them would be unwise.

Why in the world would I want to argue the merits of this case iwth you, someone with no money who lives in a public housing project for poor people? Search the address she posts everywhere as her "stock promoter central" office. It's a housing proj ect. Who would take stock advice from someone who lives in a housing project? Obviously you don't know how to pick stocks or make mo ney.
