No, that is not true. In fact it was "for failure to make a prima facie showing of jurisdiction over the defendant under New York's long-arm statute". The court over-looked the Forums Selection Clause in my web site Rules and Regulations which Mary agreed to when she signed up as a member of my discussion forums, before she started her three year campaign to damage my reputation and ruin my business. I did not use the long-arm statute in my Amended Complaint, I used diversity and the forums selection clause. I have drawn the court's attention to that and provided cases that were decided in favor of forum selection clauses with rules of law.
