Wayne is confused because he only takes the shallow talkingpoints from his rightwing blogslog sources. It confuses him to find out that eminent domain is ancient AND that Bush made his millions by using it.

As I understand it, eminent domain is a natural right of the state. It's up to legislation to limit and refine it by, for example, requiring just compensation for it. It's not like the SC gave the government any right that it didn't already have. It simply refused to limit that right by narrowly defining 'public' use.

It then went on to say that legislation could limit that right.

It's obviously abused at times but it sure seems like it's local abuse from corrupt officials.
