I've come to the conclusion that our constitution in its present form is no longer equiped to handle some of the issues of this era. Although, I have great respect for Jefferson and the boys, the time has come for us to take matters into our own hands.

Scalia was referring to the simple reality that almost all Americans are monotheist. This situation exists independently of the actions of Congress. The manner in which we treat the minority religions is independent of whether or not we have a state religion. 1983 was, according to the Federal Government, "The Year of the Bible," but no one was out burning witches.

EXACTLY!

So neither can the other person's rights be abridged! If no abridgement is allowed a priori, then the conception of the matter must include the limitations between persons of freedom to act. Rights may be "natural" (it is a helpful concept)--but they are NEVER absolute.

I do not have ABSOLUTE liberty.. I can walk past you but I cannot (morally) strike you...unless you are an alien! ;-)

I am not (of course) challenging your response to EX--I am simply elaborating...
