I'd expect AMD would settle, *RIGHT NOW* for a promise from INTC that they'd cut it out, modify the rebate program, and play nice.

Unfortunately for AMD, playing nice is not required and it will likely turn out that the rebate program is in full compliance with the law as well. Intel did not design their rebate program in a vacuum. It was designed by experts in the Law. This will be determined in a Court of Law and not played out in the gutter as AMD is doing now.

I think Intel will settle too, but I don't think it will happen quickly. But, Otelinni is in charge, and he is capable of surprising everyone.

The chances for settlement will increase as we get closer to trial. Intel is not going to hire total morons for lawyers. They will know when they have the short end of the stick.

Intel inhouse team would probably go all the way to the defeat, if that's in the cards, since their careers, their reputation is at stake. The hired guns will be more objective, IMO.

So if the settlement doesn't happen by mid 2006, AMD will just go for full damages. (x 3), which may be a substantial amount. AMD CPU sales were about $2B per year, if AMD goes back only 3 years, and argues 30% damages (on ASPs alone), that't $3.3B x3 = $10B, which is, I believe the low end of what AMD will be demanding (the amount actually rewarded, assuming successful outcome will of course be different).
