The US hasn't been hit by a foreign invading force since 1812 (unless you concede that the Confederates formed a different country). (Pearl Harbor wasn't an invasion by my definition.)

The concept of dismissing Posse Comitatus for terrorists indicates the risks of conceptualizing the struggle against terrorism as "war."

A good argument could be made that, no matter what any administration calls it, it's not a "war" unless Congress says it's a war.
