Each time he did he was required to give advance notice to his parole officer for approval. For every single flight except the one in question, the return flight from NY to San Diego via Phoenix, inclusive of the trip out to New York, Tony used his real name. If you are skeptical of this fact, don't you think the government was as well and tried to find others? Or, at the very least, went over his parole officer's log of his whereabouts and demanded proof of any suspicious activities? When you think about it, you can't have it both ways. Either Tony was a) an evil genius who used all sorts of names and disguises and traveled the airways post 9-11, looking as he did, in stealth with ease, risking 20+ years in prison each time, or he b) was under lots of stress, wasn't thinking clearly one day, and impulsively did something really stupid. If you take out the word "impulsively" then you are ascribing it was premeditated. People who premeditate fleeing the country don't do it by fleeing from New York to Phoenix under an alias, especially when they live in San Diego and can walk across the border without so much as even showing an ID. The fake IDs were presumably used while knocking on doors asking questions. Ken Cook was one such person that Tony sought to find. There were others, but I figured the skeptical among us might want at least one example. Lastly, I think it very important to point out that the government *did* maintain Tony was trying to flee: "The evidence at Elgindy's racketeering trial established that his use of the false identification was part of his effort to flee from justice." ( usdoj.gov ) No, the jury was not charged with making this determination nor did Tony testify about it (or anything else for that matter) but I guess the government felt this was unnecessary for their purposes. Since the transcripts of the trial are posted here on SI, everyone is free to draw their own conclusion. - Jeff
