I was simply countering the idea that the good guys won. They were both good and bad. What they wrote is a great document, but they did not apply it as rigorously as we do today. And I think you'll admit that much of what is different, slavery, womens rights and the attempt at true equality are advances.

You were lamenting the interpretations of the constitution and it's status as as living document. I think it has grown with the times with new understandings of fairness and justice. What the framers can be credited with is putting the seeds of fairness, justice and balance into the constitution even if they didn't practice it as fully as they could or should.

Does it sometimes protect that which I find repulsive? The KKK for instance? Yes. And while digitally modified pictures of children are considerd free speech it does not imply a protection of a group such as NAMBLA. They are still criminals in the eye of every justice and all right thinking individuals.
