Indeed. But only when they would be embarrassed by what they're doing. They're still free to do it, they just risk embarrassment. Somehow I have trouble finding freedom from embarrassment in that constitutional penumbra.

They probably PICK their noses less

I meant to mention that anti-smoking ad on TV. Have you seen it? It's terrific, if rather gross. A bunch of people congregate on the steps of a building to pick noses just as they do for a smoke. It really gets the point across.
