Drug dependency as a disease, interprets as not under the control of the user. So, when aberant behavior results, the excuse may legitimately be blamed on the disease.

The consequenses, of bad behavior that can be blamed on circumstances not in control of the offender are usually far less ... go to detox, thirty six weeks of Wednesday evening classes and everything should be hunky dory again... except that it usually isn't.

How might drug use be used legitimately by the defense

For example: There is a case getting lots of TV distraction about a missing man from a cruise ship. The story features pictures of his wife in a bikini so it gets lots of air time. The wife has been asked why she didn't report her husband missing and her reply was that she was drunk to the point of passing out and wasn't very aware.
