10 feet is out of the question. At 10 feet the pattern of any 28 gauge load wouldn't spread more than 6 inches or so even if cheney was using an open choke. There are many different things to consider when trying to estimate the distance from the shooter to the victim. A 28 gauge shotgun usually shoots a 2 3/4 inch shell. A 12 gauge does too but a 12 gauge also shoots a 3 inch shell. I don't know if 3 inch shells are available for a 28 gauge or not. A 28 gauge shell is normally loaded with anywhere from 5/8 oz of lead up to 1 oz although 1 oz would be very rare and not advisable. Cheney was probably using a 3/4 or 13/16 load. Shotgun shells come in what is called low brass and high brass. A low brass shell is for shells which have less power. A shell of this type might be used in a place where there wouldn't be any shots of any length such as in hilly country. I think it is more normal to use low brass shells when hunting doves but cheney probably was using a high brass shell since he was in Texas where it is flat and longer shots would be common. The powder weighs approximately 28 grains and this can also vary. Cheney would probably have had a professional shoot his gun with many various combinations of lead and powder to determine what would give him the best pattern at whatever distance cheney selected. The powder also is available in slow burning to fast burning grades and this also makes a difference as does the choice of primer to use. If I were to make a guess I would say that cheney had his shells loaded slightly on the hot side so as to make the gun reach out a few more yards than the normal across the shelf load which you buy in a store. He would do this so as to appear to have a better gun which would reach out and kill the birds at a range which someone using regular shells couldn't do. This might allow him to do as much damage to a victim at 30 yards as a factory load might do at 25 yards. Cheney's gun was an over and under. You can buy these made any way you like. A normal gun might have the upper barrel be an improved cylinder and the lower one be an open choke. The open choke would allow the shot to spread out faster and would be used for closer shots. You can shoot 1 barrel at a time, both barrels at once or both barrels in rapid fire.

These aren't all of the factors which would govern how much damage cheney was capable of doing to his victim at any certain distance. I will guess and say cheney was using a 3/4 oz load with 29 grains of fast burning powder and blasted the guy with both barrels at 22 yards.
