I don't think Roberts will vote to overturn Roe, or even vote to hear the SD case, which means it won't even come up.

You think they will hide behind a lower court finding the SD law unconstitutional? The right will demand blood in that case! This is precisely what they want, a major test. It has come quicker than I thought it would.

IMO, Rove should have lobbied behind the scenes to hold this one off past the 2008 elections.
