I don't disagree that we should listen in...with appropriate congressional or judicial oversight. Checks and balances. FISA was so darn simple for GWB and the gang to comply with. Go ahead and do the tap, just justify probable cause (actually less than that as a standard) within 72 hours.

There is no reason to not get FISA approval.

It's completely possible.

You can even start the wiretap and get approval later within certain time limits.

So the argument that national security would suffer IN ANY WAY from following the law is a red herring.

The appearances are that Bush and crew just don't want to get the approvals because either 1) they are using wiretaps in a way that a judge would not approve, or 2) they resent on principle the idea of being accountable to anyone, even if the law states they have to be accountable.
