Somewhere in the fine print there is a list of eligibility criteria, and among them is probably a provision that, in order to collect, you must have sustained a loss.
I think brokers submit lists to the court that includes anyone who had a position of any kind in a given time frame. I've gotten several over the years where I was fortunate enough to be on the right side.
