Processes always look good at this stage of the game. The devil is getting it into production with acceptable yields and bin splits. Given all the various factors that now affect those two, rushing a process to manufacturing is a huge gamble.

If Intel has indeed furthered low-k for 45nm then it will virtually garantee a break through in reduced leakage. Yields however are a completely different matter. If this will play out (very low leakage at 45nm, at least somewhat low yields) then that would be as I've been expecting for a while now already. There's a price to pay for every gain.
