Public suits have been won over false reporting before. For example, Ariel Sharon successfully sued Time Magazine for reporting that he had foreknowledge of the massacres at Sabra and Shatila. It was important to him that it be established that he didn't have foreknowledge.

Similarly, it seems important to Kerry to establish that he really deserved his medals (else why bring it all up now? and the NYT is only reporting it because Kerry is bringing it up). So one would think that a lawsuit for libel is exactly what Kerry would want to press - he's a multimillionaire, he hardly has to to worry who funds the lawyers on the other side.
