Maybe Kerry will sue. But you have to be careful you're not helping the smear jockeys by suing them. Sometimes the smear jockeys want you to sue just to make a big stinky scene. And the smearvets are backed by some very deep pockets rightwing corporate money. Also, it's my understanding that you have to prove material damage, and there's no way to prove the smearvets cost Kerry the election. I do know Kerry has two ongoing lawsuits in Ohio trying to find out what happened to all his votes there. I don't know the details though.
