He doesn't have to show that they cost him the election. You can sue over loss of reputation. They said he didn't properly earn his medals, that he gamed the system. That's enough damage to sue over - if he thinks he can be cross-examined in court.

It would require that all military records be made public, however, as they would obviously be called for in disclosure. As I recall, Kerry has only released them to certain reporters.
