I did not change the rules. I pointed out a 2.33GHz Merom will use a 667MHz FSB which will also save power over a 40W Woodcrest.

It will save power in the chipset and power draw, which is higher than average CPU thermal, not in the CPU thermal rating. And 40w is not "close" when you add the MTH power draw.
