That is true. (Though having Russia pay lip service to such an effort is rather rich, considering their history. Do they count leveling Groszny with heavy artillery as a "law and order" solution?)

But a pure legal approach works for individuals or small groups. It has problems tackling organized crime, and mafias, being in it for money and not ideology, are less of a problem than terrorists. Put simply, the legal approach has a dismal record on terrorism. Just look at Germany's attempts to bring terrorists to trial. They all walked. The problem is, you can't try one without blowing your current operations.

This is indeed a major philosophical divide. Do you fight terrorism through legal means or do you wage a war. Pre-9/11 the majority opinion was for legal means. Post-9/11 the majority opinion switched to war. Kerry still has his previous opinion, though he's said a bunch of things trying to obscure that fact.
