Re: "Ness was a publicity hound. Do you think Spitzer models himself after Ness?"

Very interesting comparison! (I hadn't thought of that before....)

It may be that that character trait is required to be a successful prosecutor (or not....) I believe it's safe to say (based solely on their respective conviction ratios) that *both* are/were highly 'successful' prosecutors... but it seems that Spitzer is capitalizing on a political future that Ness was never able to pull off....

Re: [Prosecution] "You may be correct that there are no charges pending,"

Well... none actually filed to my knowledge.

"but we will have to wait and see."

Yep, 'tis true. (IMO, the admin. *does not want* that test of power in the federal courts --- they stand to lose far too much that they have already grabbed.)

"For the Times if they are not charged it is a winning situation."

Quite the OPPOSITE --- they lose by being the butt of political attacks from the WH... and without the chance for a clarifying 'Pentagon Papers type' win in the courts to validate the legality of their actions. For the NYT, (in the short-run at least), it's all down-side and no up-side.

"It really boils down to one thing. If the President had sought and the Congress had granted a Declaration of War instead of authorizing the use of force...."

On THAT POINT you are ENTIRELY CORRECT!

Congress --- in recent decades --- has acted in a spineless manner, abrogating most of their Constitutionally mandated responsibilities, and much of the current mess can be laid right on their doorstep because of that gutlessness.
