The dictum by Byron White i.e. in the Pentagon papers would indicate that NY Times could be liable for violation of the Espionage Act. The Point is that after the courts have decided , then Congress can decide the proper course of action and amend the laws or create new laws as necessary. The present situation is not good as you indicated . Winning IMO is not everything. Everything is advancing your values and policies in the proper and correct way. How is as important as What . This situation screams for a lawsuit, indictment. The problem is that indicting the reporters would lead to a 5th amendment privlege and you would never get the leakers. I would agree with you that better to leave out the reporters and give them use immunity- not transactional immunity- so you could get their testimony.
