I certainly have a better idea about the criteria than you do. And the military lawyers who swarm around such operations, and their legality, certainly have a better idea than both of us.


Well I hope somebody does since I have virtually no idea, and as far as I know the government hasn't made it public.

Of course, you don't have any alternatives for where to hold such dangerous people, except to let them go.

I have no proof that the people in Gitmo are even dangerous. How can you make that determination without knowing what the charges against them are? How can you make that determination without knowing the evidence that supports the charges?

As for how they would be treated if they were returned to their country of citizenship, I imagine it would depend on the charges against them, which again I have no idea about since it hasn't been made public.

The freedom loving USA should not hold prisoners for years if we can't prove that they are a threat to the US. If we can prove it, then try them and convict them. If not, why in the world are we holding them? It's ridiculous.

Of course not, but nobody cares how their own countries treat them. The issue is not how they get treated, but on whom the alleged mistreatment can be blamed. Look at the debate about rendition. Nobody is yelling at Egypt or Saudi Arabia for how they treat the prisoners they receive.

Don’t we have pretty dangerous people in regular prison? We even have “super max” prisons for the worst of the worst. Maybe we have run out of room there, so that’s why we still have Gitmo. Any chance we could put these guys in a super max? I'll bet our tough guys can beat up their tough guys.

I will join others who have said that the reason these guys are not in regular prison is so that they can be denied due process outside of the US court system.
