No they don't. But if we go to war with a country who is harboring terrorists or is in sympathy with them, then our soldiers are at risk. And it is an unnecessary risk.

Things like torture are unlikely to yield actionable intelligence. Plus, it degrades the effectiveness of the troops when they are in an environment where such things are allowed or encouraged. And finally, it turns world opinion against us. With so many negatives and almost no positives, it is stupid to practice it.

That is stupid. The Constitution is central to what makes America what it is. To circumvent it because following it inconvenient means we are that much closer to a dictatorship. If you wonder why you get awarded the label of "fascist" it is because of statements like that. People like you are a greater danger to this country than any terrorist.
