Capturing enemies in a time of war doesn't make for a police state.

In a real police state you wouldn't have heard much about Padilla. He simply would have disappeared.

Because to not do so is controversial.

Also I never said it isn't unconstitutional, I said it was not clearly unconstitutional. I've also said the administration position is not ridiculous, but at the same time I said I wasn't endorsing it.
