It is important to remember that such silence is a mere allegation by Nokia at this time, which they bear the burden of proving, along with all other elements of estoppel. As between Nokia`s aggressive pleading ploy, and an assumption that Qualcomm was ignorant or inept in their conduct and/or communications, until/unless proven otherwise, it is the former.
