Clearly it's a crime to misuse speech. You can't yell fire in a crowded theater. You can't slander or libel.

I see no crime committed by Jones, or any of the other conspiracy theorists. What harm have they done? If the harm is to reveal the truth, is that a crime? If they make an ass of themselves is that a crime? Have the "moon landing" conspirators committed a crime?

Should we round up anyone that goes against the view of the government? Anyone that does not accept the 9-11 Commission report as gospel is an enemy of the government? Anyone that doubts the Warren Commission report is a criminal?

I think that the framers included freedom of speech not so you and I could chat about what we believe, but so that the government would not be able to silence opposing views.

If the government is to silence anyone because they brought harm, then it will be the onus of the government to show that they have been harmed. In this matter they will need to be completely clear about their case and be ready to show the harm done, and to show that it was done with malice of intent and that Mr. Jones truly went against his own beliefs to lie.

I do not believe that to be the case here. And clearly if any crime has been committed, by BYU or the hand of the government, it has been the crime of abridging free speech.
