Is there a tactical benefit to submitting such a preliminary request such as presenting arguments and facts to the judge, so that he is more familiar with the issues?

I love positive spins, but I do not think the judge's comments can be called a neutral event. Clearly, there would have been a "right" to an injunction but the Judge said that Q had not established evidence of that right in this case. I think the comments of the judge have weakened Q's bargaining position in the settlement discussions of next week.

Not getting a preliminary injunction is simply not a big deal.

As an aside I think there is another play here. Qcom is firing a shot across brcm's bow that the latter's shareholders and mr. market don't like uncertainly. Now q is confirming the uncertainty as to brcm's ability to play in the 3g chip market.ihavenoidea
