i'm not a lawyer but Section 3 of the Clayton Act says: "It shall be unlawful for any person engaged in commerce ... substantially lessen competition or tend to create a monopoly in any line of commerce." it seems to me that if one is found to have violated this clause, it maybe interpreted as one having created a monopoly. standard oil has been found guilty of this.

Wasn't MicroSoft declared a monopoly as one of the findings of their anti-trust trial?
