"What this bill does is reverse 500 years of common law history and said the President, the king, the executive can throw somebody in jail without needing to justify it to a court. That violates the rule of law and it violates our Constitution."

These guys think the Fourth Amendment applies to non-resident, non-citizen aliens caught waging war against the US. It's strange how at some point in the last 60 years people started thinking US criminal procedure is universal.

I read the Military Commission act and the objections to it are not well founded. It applies to Aliens only and has lots of due process, fair rules of evidence , no death penalty except with unanimous ruling of at least 12, lots of review procedures including appellate courts and Supreme Court. The statements made in the news are either deliberately misleading or profoundly ignorant.
