I don't think it's the same argument at all. Folks that are for marijuana legalization mostly think it's less harmful than, say cigarettes or booze. Yet people are criminalized for using it. And if it were legal you could tax it. Save money on jails as well.

The "getting rid of a black market" is an ancillary argument maybe.
