"For example, most conservatives would probably say that our constitution guarantees U.S. citizens certain rights if they happen to get arrested. Access to a lawyer, a speedy trial, the ability to confront the witnesses against them, etc. However, these conservatives seem to leave themselves an out for certain situations. So these constitutional guarantees might not apply if we're all really, really scared. I'm thinking of the Jose Padilla case, here."

I hardly think that due process is only a Conservative value. Are you suggesting that Democrats would not protect the country under emergency measures?

I'm not going to get sucked into discussion of liberal vs. conservative notions yadda yadda yadda with you.

Your premise in our discussion smacked of situational ethics. You seemed to be saying that application of First Amendment rights should depend on the motivation of the speaker. I disagree with your premise.

If you don't like the notion of situational ethics, you should not employ it. Don't turn this discussion into something else. Changing the subject doesn't get it with me.
