Precisely. But the present situation is an example of how such things get resolved. Bush is setting up a situation where Congress will pass legislation spelling out certain restrictions on the CinC. Bush will likely veto it, or sign it with an attached signing statement on why he won't follow the law. That will set up a scenario where Congress can impeach him, like what happened with Andrew Johnson, and there might be enough Republicans miffed at the signing statements in general to make the impeachment successful.

If vetoed and given the present climate, it is likely that Congress would over-ride the veto. That leads to same signing statement.
