The problem is the US didn't obey the conventions and kill them when they caught them.

Simpler is better.

I don't know about all the prisoners in Gitmo, but those who killed medics, or wore civilian clothes or were spies or were terrorists should have been shot when captured.

Agreed, but if they killed a medic and were captured instead of killed at that time, they should be put on trial for killing the medic, and executed today.

I agree, but it seems there should be some "laws of war" which pertain to how the populace of an invaded country is expected to behave. They were all caught in a foreign land that the US invaded on a UN sponsored mission. What did the Gitmo people do? We don't know. Do you? If the Northern Alliance comes ripping through a village, and went to the house of some guys Abdul, and asks him "Do you support the Taliban", and Abdul answers "Yes, in fact my gun is in the living room", does Abdul end up in Gitmo for life? If Abdul sees the Northern Alliance ripping through his village and in fact stealing his goat, and Abdul fires a few rounds at the guy trying to steal his goat, does Abdul wind up in Gitmo for life? If Abdul is a Taliban soldier, and his division never even fires a shot - rather the 50 of them all surrender, and one of them is well known Taliban killer bad guy #3, does Abdul and his 50 fellow soldiers end up in Gitmo for life?

It's pretty hard to discuss, because we don't even know what the detainees are accused of.
