The libertarian in me chafes at the idea of legislation on this issue, but it really is a safety issue.

If some states (mine for example) are going to legislate for my own safety and require that I wear a helmet while riding my motorcycle, I don't see why they can't legislate for my safety and require the idiot in the other lane not to drive while a cell phone is glued to his/her ear.

I've heard of studies that contend that the distraction caused by talking on a cell phone while driving creates just as hazardous a driving condition as driving with a 0.08 BAC.
