Xeroxing classified documents often isn't lie photocopying the pages of a history book at a library. The copies have to be made on special equipment, and their creation, and handling are restricted. It may not have been legal for Berger to have made the copies, and it if was the copies would be controlled, not just something Berger could create and move as he pleased.
