Interesting proposed remedy on pg. 33:

"The Court sees the obvious connection between the ‘104 and ‘767 patents and H.264 compliant products. Therefore, the Court is inclined to consider a remedy consisting of (1) independent unenforceability of the ‘104 and ‘767 patents against any H.264 compliant products, and (2) inclusion of the ‘104 and ‘767 patents in the MPEG LA patent pool, which receives royalties from H.264 compliant producers that are divided between all owners of patents related to the H.264 standard who are members of the pool. The extent of Qualcomm’s share of the royalties based on the ‘104 and ‘767 patents would be determined in accordance with procedures in effect in the MPEG LA pool."

Indirectly it seems like the equivalent of a finding of infringement.
