The prepared remarks of three presenters in the ITC Commission hearing are now online. Based on a quick-scan, all three advocate blocking importation of downstream products, mainly 1xEV-DO handsets. The three are ...

Dr. Paula Stern, former chairwoman of the USITC, present chairwoman of The Stern Group
Dr. Simon J. Wilkie, executive director of Center for Communications Law and Policy, USC
Karen J. Norton etal, investigative attorney of Office of Unfair Import Investigations (OUII)

edisweb.usitc.gov

To the credit of the OUII, they do not recommend blocking importation of handsets which are programmed to not infringe, IOW when the power-saving feature is disabled.

Warning: Reading these three presentations will probably not give you a warm-and-fuzzy feeling.

---> so how has the "value" of Q's IP changed over the years

The fundamental cdma patents expire over the next few years and that will mean a significant change in the "value" of Q's IP. That loss is offset by the significant gain in value for the EVDO/HSxPA patents.

Nokia is right that the situation is now different but that doesn't necessarily translate into Nokia being right about the value of either parties current IP.
