How come such a popular misquoting of the constitution then that Congress is the official declarer of war, NOT the president? I suspect you are wrong on this one Lindy. I shall give Google a quick chance at giving me the dinkum oil on who is in charge of war in the USA.

I'll stick with what I know unless you can come up with something to refute it.

You will have to get into Bill Clinton style legalisms on the definition of 'is' and 'sex' to make your case. Sure, Congress authorized and POTUS is waging war. If Congress changes their mind, I don't think POTUS can refuse them their decision. It all looks straightforward to me.

Being a official international constitutional expert I can state categorically that the USA going to war, as in CHOOSING a war, requires BOTH Congress and the President to be in agreement and the same with continuing it.

If the USA becomes at war by the act of some attack on the USA, then I think the USA is ipso facto at war, irrespective of what Congress or the President think so by default, the USA is at war in which case the President is the wielder of force in defence of the realm and should get to it.

So, with the attack by the Taliban and Osama, I don't think King George II needed to ask permission before launching an attack in response, but with the passage of time then it would be good form and an obligation for Congress and the President to agree on continuing the war by way of an offical declaration of war against Afghanistan and their agent Osama and co.
