European Patent 0695482 is no longer considered ESSENTIAL IPR.

"On 29 November 2006, Qualcomm Inc. has requested ETSI to withdraw the following IPR from the ETSI IPR Online Database: Patent No.: EP 0695482; Patent No.: DE 69520812.8; Patent No.: US 5,452,473; Patent No.: ZL95190118.4.

Nice find. This is definitely going to be one of the areas of argument since Q no longer wants these patents to be subject to the FRAND standard.

Unfortunately, this points to another mistake by Qualcomm. The fact that they initially submitted the patent as essential will severely undermine their arguments.

We Examined Our Conscience and ...

... decided "to re-examine thoroughly the essentiality of this patent family in the course of patent litigation and as a result does not consider that these patents are Essential IPRs."

Ron,

<< European Patent 0695482 is no longer considered ESSENTIAL IPR. ... As the FRAND argument then doesn't apply that might actually be to Qualcomm's advantage ... >>

At the very least it saves them from being called low down dirty rotten pond scum by their peers for surfacing their submarine. <g>

Good catch. Did you happen to search up any of the other submarine patents previously declared to be essential?
