I think the delay bodes well for QCOM. As you noted, if the commission merely accepted its staff findings, then it could act reasonably fast. But the commission members undoubtedly must be worried about the unintended adverse impacts on companies like Verizon and Sprint, not to mention their wireless subscribers.

The other point that was made by the administrative law judge in his recommendation against banning all imports is that there are other remedies available to BRCM, which would not hurt service providers and subscribers. In fact, a ban on imports would hurt even BRCM because initially fewer handsets would be sold, depriving BRCM of any royalties it otherwise might receive.

It's clear that BRCM intended to use the ITC as leverage to obtain a license and royalty arrangement from QCOM that would give BRCM a competitive advantage over other chip makers. I don't know if BRCM would accept anything less than a discount, but if such a deal was in the works, it would drive a nail right through the QCOM claim that its licensing and royalty arrangements have always been uniform and consistent.

If QCOM has a true workaround for the power management issue, then I would not be overly concerned about the details of all these related issues. But what troubles me is that I don't know if QCOM really has a workaround, or if it simply means not activating the power management software in certain MSM chips.

It sounds to me like there is an opinion or probably a draft opinion circulating that is having difficulty attracting a majority.
