6-Year-Olds Under Arrest

Apr 09, 2007

Erica Little

Overcriminalized.com takes note of stories relating to so called “zero-tolerance” school discipline policies that treat childhood misbehavior as criminal. Many of them, like this one, have to do with minor disciplinary infractions that are treated as criminal offenses in an effort to rid schools of weapons and violence.

Even those who are familiar with zero-tolerance stories will be shocked by the arrest of 6-year-old Desre’e Watson in Avon Park, FL, as described in this NY Times article by Bob Herbert. According to the author's interview with the Avon Park police chief, Desre'e had an extended tantrum that teachers could not control. The police were called and they handcuffed the 6-year old's biceps, took her down to the station, and had her fingerprinted and photographed.

Well, someone needs to ask how bad is the crime level of 12 year old boys with pocket knives in Virginia. Certainly we cannot afford to allow anyone civilized to venture to Virginia as a tourist if they have to be that vigilant because of the rampant crime problem.

So many excesses - where to start? How 'bout sanctions for the hearing judge for even hearing a case where his client was the complainant? mph, what say you?

BTW, we get a couple of the zero-tolerance-run-amok cases in GA every year. On the absurdity scale, this one doesn't even rank that high.

Of course, we also have the kid who's doing ten years for betting a BJ at a party from a sophomore from his HS when he was a senior. He was 17, she was 15. Had he just gone ahead boinked her, it would've been a misdemeanor. Instead, he gets felony child molestation and a life on the sex offender registry. The DA and judge decided to make an example of him because he wouldn't plea out like two or three other guys at the same party and take a two or three year sentence.
