Price fixing is a more specific defined term, so in that sense its better.

OTOH, you don't really have evidence of price fixing, at least not evidence with any real solidity.

As to the more general idea of "gouging" or just higher prices -

As for retail and pump prices not moving in sync, that really isn't evidence of anything. Both face somewhat independent supply and demand factors. Certainly they are connected, and you wouldn't expect them to move in strongly independent ways for an extended period of time except in unusual circumstances, but in the short run there isn't any reason why they have to follow each other.
