Smoking is a health risk to others, not just the smoker. It's well documented the effects of 2nd hand smoke. Also it's a general nuisance. Non-smokers have to endure having smoke residue get on their clothing, stinking it up. If I were driving a car and ran over a puddle and covered you a pedestrian with filthy water I'd be liable for the cost of dry-cleaning the clothes, not to mention the cost of inconveniencing you if you missed any important meeting. Smokers should either be held liable for harming the health of others and the general nuisance. The employers should be held liable for allowing it to happen in their workplace. You understand that concept? It's not a matter of PREFERENCE. It's a matter of consideration for your fellow man to boot. You "libertarians" always think of the right of the individual to do whatever they damn well please and forget the consequences. That sort of ethic sickens me. I'm thinking now that you personally smoke. Well I wish you all the best in your health.
