Our loss is paid by my insurance co.

They then have subrogation rights to pursue the person that caused the damage/injuries.

In addition:

She got a ticket for about $200 or so for the rear-ender and another for $400 for not having insurance.

The Department of Licensing will require her to post a financial responsibility bond for the amount of estimated damages. If she does not, she loses her license.

On top of it all, I'd say her car is totaled.

That's a lot of headache, all for having saved a few hundred dollars in insurance premium.
