And about 1/2 the states have caps on malpractice awards (I can't find a current list). And the other states are free to pass the same legislation. It's a state's rights issue, not a Federal issue. The states regulate that "industry".

I know you are not against states rights.

I don't disagree with reasonable caps on malpractice awards. But, I also think MD's performance records should be easily obtainable public information, and the profession shouldn't police itself.

Perhaps the entire medical malpractice "industry" could be eliminated with government provided, single-payer healthcare? Just make that part of the bargain.

It would seem that Canada at least retains malpractice problems:
