"I believe Sewell is familiar with the law."

Clearly not if he thinks that is legal. Ask 3M about the LePage decision. 3M did something similar to this, and lost.

And AMD's legal response was the correct one. If Sewell's quote is accurate, then Intel isn't using only "reasonable, stepped discounts". A reasonable, stepped discount is something like "quantity 10 $XXX, quantity 10000 $XX". Not "quantity 10% of your total business $XXX quantity 100% of your business $XX". The former is legal. The latter is not.

And this isn't merely my opinion. Again, ask 3M.

wb, Re: Somehow, I won't be holding my breath waiting for that instant judgement against such an obvious legal faux-pas...>

Neither will I.

I, as well as CJ, doubt Sewell said any such thing.

At least in public.

Re: AMD’s Diamond replies: “If, in fact, Intel’s corporate policy is to use only reasonable, stepped discounts and no first-dollar rebates, that’s a pretty recent innovation, and I guess we’ve earned part of our legal fees already. That has not been historically correct.”

So your defense for running over a bunch of people on the sidewalk is to say you're going to stop doing that in the future when you're evading red lights?

Good luck with that defense in court.

Let us know how it turns out for you.
